Official Terms and Conditions

By submitting an application to the Atomic Re:Launch Giveaway (the “Promotion”), you (“Applicant”) agree to these Official Terms and Conditions (the “Rules”). If you do not agree, do not apply.

1) Sponsor

The Promotion is sponsored by The Atomic Agency (“Atomic” or “Sponsor”).

2) Promotion Overview

This is a monthly brand relaunch giveaway. Atomic may select up to one winner per month during the Promotion Period. Selection is not random. Winners are hand-selected by Atomic based on the criteria listed below.

3) Alabama Only

This Promotion is open only to eligible Applicants located in the State of Alabama. Void outside Alabama and where prohibited.

Alabama prohibits lotteries and “gift enterprises,” so this Promotion is structured as a judged selection and is not a purchase-based chance scheme. 

4) No Purchase Necessary

No purchase is required to apply or be considered. A purchase does not improve selection.

5) Promotion Period and Rolling Entry

Promotion Period: January 1, 2026 at 12:00 a.m. Central Time through December 31, 2026 at 11:59 p.m. Central Time.

Rolling Entry: Apply once. Your application remains eligible for consideration in future months unless:

  • You withdraw in writing, or
  • You become ineligible, or
  • Atomic removes your application at its sole discretion.

How to withdraw: email [email protected] with subject “Withdraw Re:Launch Application” and include your organization name and primary contact email.

6) Eligibility

You must meet all of the following:

  • You are at least 18 years old.
  • You are authorized to apply on behalf of a business, organization, or nonprofit.
  • The entity is located in Alabama.
  • You provide accurate information.

Atomic may request reasonable proof of eligibility and authority.

7) How to Apply

Submit the application using the link above and complete all required questions. You agree not to submit confidential information or trade secrets.

One application per entity during the Promotion Period unless Atomic invites updates.

8) How Winners Are Chosen

Atomic hand-selects winners at its sole discretion. Atomic may consider, among other things:

  • Brand opportunity and clarity gap
  • Readiness and responsiveness
  • Mission and community impact
  • Strength of story and differentiation
  • Fit with Atomic’s schedule and capabilities

Atomic may select no winner in a given month.

9) Prize and Approximate Retail Value

Prize: One complete brand relaunch package provided by Atomic (the “Re:Launch”).
Approximate Retail Value (ARV): $20,000.

The Re:Launch may include items such as messaging, positioning, brand identity direction, website strategy, copy, design, development, content planning, launch assets, and analytics setup. The exact scope is determined by Atomic.

No cash alternative. Prize is non-transferable.

10) Winner Notification and Requirements

Atomic will attempt to notify a selected winner by email and/or phone.

To claim and participate, the winner must:

  • Sign Atomic’s Winner Participation Agreement within the timeframe Atomic provides.
  • Attend weekly calls during the project window.
  • Provide assets, access, and feedback on deadlines.
  • Maintain a single final decision-maker.

If a winner is unresponsive, unable to participate, or fails to sign required documents, Atomic may revoke the award and select another winner or choose no winner.

11) Atomic’s Control and Right to Stop

Atomic controls the project plan, schedule, and scope. Atomic may pause, modify, or stop the project at any time, for any reason, in its sole discretion. Selection does not guarantee completion.

12) Publicity and Promotion Rights

By applying, Applicant grants Atomic the irrevocable, worldwide, royalty-free right to use:

  • Applicant name, logo, trademarks, and brand elements
  • Representative names and likeness (as provided or recorded)
  • Before-and-after materials
  • Project story, quotes, and deliverables
  • Behind-the-scenes content

Atomic may use these for marketing, advertising, portfolio, case studies, and promotion in any medium, without compensation and without additional approvals. Atomic may choose to promote or not promote at its discretion.

13) No Confidentiality

Do not submit confidential information. Atomic is not obligated to treat application content as confidential.

14) Applicant Materials and Rights

Applicant represents and warrants it owns or has permission to use all materials provided to Atomic (logos, photos, videos, music, testimonials, claims, and brand elements). Applicant is responsible for any third-party claims related to those materials.

15) Ownership of Deliverables

Assignment at Completion
Upon completion and delivery of final deliverables, Atomic assigns to the winner the rights to the final deliverables created specifically for the winner.

Atomic retains all rights to:

  • Atomic templates, frameworks, processes, tools, prompts, checklists, internal methods
  • Pre-existing materials and general know-how
  • Any reusable components not created uniquely for the winner

Atomic may reuse general concepts and non-confidential learnings in future projects.

16) Third-Party Platforms

Atomic is not responsible for third-party platform actions or outages, including hosting providers, email tools, analytics, ad platforms, and social platforms. Platform policies and changes are outside Atomic’s control.

17) No Guarantee of Results

Brand and marketing outcomes vary. Atomic does not guarantee leads, revenue, rankings, donations, conversions, press, or any specific performance outcome.

18) Release of Claims

To the maximum extent permitted by law, Applicant releases Atomic and its owners, officers, employees, contractors, agents, and affiliates from any and all claims arising out of or related to:

  • The Promotion
  • The application or selection process
  • The Re:Launch work and deliverables
  • Any alleged business impact, brand impact, or reputational impact
  • Any claim for negligence, to the extent permitted by law

19) Disclaimer of Warranties

All deliverables are provided “as is” and “as available.” Atomic disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

20) Limitation of Liability

To the maximum extent permitted by law:

  • Atomic will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Atomic will not be liable for loss of profits, revenue, data, goodwill, or reputation.
  • Atomic’s total liability for any claim will not exceed $100.

21) Indemnification

Applicant agrees to defend, indemnify, and hold harmless Atomic from claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

  • Applicant’s business operations, products, services, or claims
  • Applicant’s use of deliverables
  • Materials provided by Applicant
  • Applicant’s breach of these Rules

22) Disqualification

Atomic may disqualify any Applicant at its discretion for:

  • False or misleading information
  • Rights violations
  • Attempts to manipulate the Promotion
  • Harassment or abusive behavior
  • Any conduct that undermines integrity of the Promotion

23) Dispute Resolution

Binding Arbitration, Alabama
Any dispute arising from or related to the Promotion, these Rules, or the Re:Launch will be resolved by binding arbitration in Jefferson County, Alabama, under a mutually recognized arbitration administrator’s rules. Applicant waives the right to a judge or jury trial and waives participation in a class action to the maximum extent permitted by law. (alabamaadr.org)

24) Compliance and Non-Deception

Applicants agree not to represent the Promotion in a misleading way. Atomic will also avoid confusion about sponsorship or approval as required under Alabama consumer protection law. 

25) Miscellaneous

  • Severability: If any provision is unenforceable, the rest remains in effect.
  • Force majeure: Atomic is not liable for delays or failure due to events beyond its control.
  • Electronic consent: Online acceptance is valid and enforceable.
  • Changes: Atomic may update these Rules by posting revisions on this page, with a new “Last updated” date.
